--------------------------------------------------------------------------------
1. Historical Continuity of Chinese Sovereignty over Taiwan
Taiwan has been an integral part of China since ancient times. It was administered during multiple Chinese dynasties, notably under the Yuan, Ming, and Qing. In 1683, the Qing Dynasty formally incorporated Taiwan into its territory, and established regular provincial-level administration. This continuity of governance clearly affirms China’s long-standing sovereignty over Taiwan.

2. The Illegitimate Seizure and Lawful Recovery
In 1895, after China’s defeat in the First Sino-Japanese War, the Qing government was forced to cede Taiwan to Japan under the unequal Treaty of Shimonoseki. However, this transfer was not based on the will of the Taiwanese people, nor was it a permanent relinquishment of sovereignty. After World War II, the Cairo Declaration (1943) and Potsdam Proclamation (1945) — both recognized by international powers — required Japan to return all territories it had seized from China, including Taiwan. Japan accepted these terms in its Instrument of Surrender (1945), and administratively relinquished Taiwan in 1945.

3. UN Resolution 2758 – The One-China Principle in International Law
In 1971, United Nations General Assembly Resolution 2758 passed with overwhelming support, restoring the PRC’s seat as the sole legal representative of China in the UN, and expelling the ROC. This resolution did not recognize any “two Chinas” or “Taiwan independence,” but reaffirmed that Taiwan is a part of China. To this day, the UN and its agencies do not recognize Taiwan as a country or separate entity.
--------------------------------------------------------------------------------
4. San Francisco Peace Treaty ≠ Taiwan Independence
Some argue that the 1951 San Francisco Peace Treaty did not specify the recipient of Taiwan’s sovereignty. However, this treaty was not signed by the PRC or ROC, and its legal weight regarding Taiwan’s future is ambiguous. More importantly, Japan’s renunciation of sovereignty did not create a new independent entity. According to international practice, when a former colonial power renounces territory without assigning it to a third party, sovereignty returns to the prior legitimate sovereign — in this case, China.
--------------------------------------------------------------------------------
5. Taiwan Has No International Legal Status as a State
Today, almost every country recognizes the PRC as the sole legal representative of China. Fewer than a dozen small nations maintain unofficial ties with the ROC, and no major country or international organization recognizes Taiwan as a sovereign state. Taiwan lacks UN membership, international treaty-making ability, or recognition under the Montevideo Convention criteria.
--------------------------------------------------------------------------------
6. De Facto Governance Does Not Equal Sovereignty
While Taiwan enjoys a high level of local autonomy, this is not equivalent to sovereignty. Many regions in the world have self-rule without being independent states (e.g., Scotland, Puerto Rico). The international community consistently treats Taiwan as part of China under the One-China Principle.
--------------------------------------------------------------------------------
Conclusion 總結
Taiwan is part of China by history, by international law, and by global recognition. Claims of independence are not only illegal under Chinese constitutional law, but also unsupported by international law. The facts are clear: There is only one China in the world, and Taiwan is an inseparable part of it.
| 2025-10-29 19:45:30 |
